Terms of Service.

These terms govern your use of Oak, the financial intelligence platform operated by Oakmont Kingsley Ltd. They're written to be read, not buried — but they are a contract, so please read them before you sign up.

About these terms

These Terms of Service (“Terms”) form a legally binding agreement between you and Oakmont Kingsley Ltd (company no. 17077319), whose registered office is at 66 Paul Street, London EC2A 4NA (“we”, “us”, “Oakmont Kingsley”, “Oak”), in respect of your access to and use of the Oak platform and any related services (the “Service”).

By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm that you have authority to bind that business, and these Terms apply to that business as well as to you personally.

Using Oak

You must be at least 18 years old and legally able to enter into binding contracts to use the Service. You may only use Oak for lawful business purposes within the United Kingdom or the jurisdiction in which your business operates.

We may update, suspend or discontinue any part of the Service at any time, and we may change these Terms from time to time as set out below. Continued use of the Service after a change means you accept the updated Terms.

Your account

You are responsible for keeping your account credentials secure and for all activity that takes place under your account. You agree to notify us promptly of any unauthorised use or security breach. We may suspend or close an account where we reasonably believe it has been misused.

You warrant that the information you provide when registering and using the Service is accurate and kept up to date.

The Service

Oak provides AI-driven financial analysis, forecasting and decision-support tools for small and medium-sized businesses, including a CFO Advisor that produces guidance based on the data you provide. The Service is provided on a software-as-a-service basis.

We do not guarantee that the Service will be uninterrupted, error-free or that any analysis will be accurate, complete or suitable for your circumstances. You should always exercise your own judgement before acting on any output.

Fees and billing

Paid plans are billed in advance on a monthly or annual cycle, as selected by you. Prices are shown on our pricing page and may change; any change to your plan takes effect at the start of your next billing cycle.

Payments are processed by Stripe; we never receive or store your full card details. You can cancel at any time from the billing portal, and your subscription continues until the end of the period you have paid for. Unless required by law, fees are non-refundable.

Acceptable use

You agree not to: use the Service for any unlawful purpose; upload data you do not have the right to provide; attempt to access, reverse-engineer or disrupt the Service or its infrastructure; or resell or sublicense access to the Service without our written permission.

We may take action, including suspension or termination, where we reasonably consider that you have breached these acceptable-use requirements.

Your content and data

You retain ownership of the business data and information you submit to the Service (“Your Data”). You grant us a limited licence to use Your Data only as necessary to provide the Service to you, including generating your analyses. We will not sell Your Data or use it to train models for the benefit of other customers.

You are responsible for ensuring you have the necessary rights and consents to submit Your Data, including any personal data it contains. How we handle personal data is described in our Privacy Policy.

Our intellectual property

The Service, including its software, design, content, branding and the Oak name and marks, is owned by Oakmont Kingsley Ltd and protected by intellectual-property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

No regulated advice

Oak provides strategic financial decision support, not regulated advice. The Service does not constitute, and should not be relied upon as, legal, tax, accounting, audit or regulated financial advice, and Oakmont Kingsley Ltd is not authorised to provide such advice. Oak does not file returns, prepare statutory accounts or make lending decisions.

You should consult a suitably qualified and regulated professional before making decisions based on the Service. You remain solely responsible for all decisions you make.

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, conditions and representations, whether express or implied, in relation to the Service.

Limitation of liability

To the maximum extent permitted by law, neither Oakmont Kingsley Ltd nor its affiliates shall be liable for any indirect, incidental, special, consequential or loss of profits, revenue, data or business arising out of or in connection with the Service.

Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us for the Service in the twelve months preceding the event giving rise to the liability. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be limited by law.

Indemnity

You agree to indemnify and hold harmless Oakmont Kingsley Ltd and its affiliates from any claims, losses, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or Your Data that you submit.

Term and termination

These Terms run from the moment you start using the Service and continue until your account is closed. You may close your account at any time from the billing portal. We may suspend or terminate your access if you breach these Terms, or for any other reason on reasonable notice.

On termination, your right to use the Service ends. We will retain Your Data for a limited period to allow you to export it, after which it is deleted in accordance with our Privacy Policy.

Changes to the Service and these Terms

We may update these Terms from time to time. Where a change is material, we will notify you through the Service or by email. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.

Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that you may bring a consumer claim in the courts of the country in which you reside if you are a consumer.
